Final Update for July

We got rained out at the Black Gold Rally after picking up a few members.
But things have moved along much better during this past week. We came back to the office and Dee and I Co-hosted the TV Show. I went home to refill my oxygen bottles, pick up some meds at the hospital that had to stay refrigerated and also picked up two fitted belts for my hernia which continues to grow.

Came back to the office on Friday and went up to speak with the American Legion Riders in Killeen on Saturday. There was a good turnout with several AL Riders from different Posts present and they had really set things up nice for us. We had a beautifully decorated table to set up our gear and a fine meal had been prepared. There were members from other Clubs and Independents present as well. Several of those present were wearing our Patch including the Boozefighters M/C from Waco.

We explained what TMRA 2 is all about and told some Bills we had gotten passed and helped kill within the past few years. When we left the Post we had signed up 38 members including one life member and accepted donations for travel expenses. This meeting ranked as #4 for the support we received at any one time during our existence. Thanks to Andrew Schaumburg for the invitation to visit with this great group.

We then went on to Temple to visit with Midget and Sue for a little while.
He will be laid up for 3-5 weeks this time as he broke his neck in two places along with other injuries.

Yesterday we attended the Austin Area COC Meeting at Cindy’s gone HOG WILD. Gimmee Jimmy announced a new concept of how the COC will become more active in the political arena. We will lay out the whole plan at the August 18th meeting. Suffice it to say that it will give Texas Bikers far more political clout than we have been able to muster in the past few years. I was glad when he announced the plan at the beginning of the meeting. I want to thank him for laying it on the table and say that I support this idea completely.

The concert tickets went on sale last Monday and were already being sold several at a time on that day. There are only 2000 tickets available so if you wish to secure one you probably need to call them and order your tickets soon. The number is 512-389-0315. When we were in Killeen several of those present had already bought tickets or were planning to do so.
Special thanks to those Warriors who have sent donations to help pay the cost of the venue for the concert. We will be going tomorrow to try to line up some bike shops as sponsors to help defray the cost. We will be offering to place a banner at the event showing them to be sponsors along with two VIP Tickets for the concert. We will also include a six month sponsorship of our TV Show where they will be thanked as sponsors on the show each Tuesday evening for that time frame. The cost will be $500.

Right to Repair Bill Introduced in US House
The Motorcycle Riders Foundation (MRF) reports that the U.S. House of Representatives has re-introduced legislation that would return the right to repair to the vehicle owner instead of the original manufacturer.
Thanks go to Rep Ed Towns, D-NY who introduced the Motor Vehicle Owners'
Right to Repair Act (HR 2694) into the 110th Congress. Joining Rep Towns as original co-sponsors were Reps G.K. Butterfield, D-NC; Anna Eshoo, D-CA; Steven LaTourette, R-OH; George Miller, D-CA and James Moran, D-VA.
The need for right to repair legislation has become apparent due to the increasing use of computers and electronics that control nearly every motor vehicle function from fuel delivery, braking, lighting, and emissions to entertainment. Although computers provide many benefits to motorists through improved fuel efficiency, comfort and safety, they also provide increasing opportunities for motor vehicle manufacturing companies to lock out access by car owners and the independent repair shops where owners choose to obtain service for their vehicles. HR 2694 would require that car companies provide full access to all tools and service information needed to repair motor vehicles, thus leveling the competitive playing field between dealers and independent repair shops.
HR 2694 is similar to last years measure (HR 2048); however some differences exist between the two bills. This year's legislation had to take into account several factors, including the new leadership in Congress and Committees. In addition, although sponsored by the sitting Energy and Commerce Committee Chairman Joe Barton (R-TX) last Congress, HR
2048 barely limped out of subcommittee and failed to be taken up by the full committee or the House floor.
Dealing with the new Chairman John Dingell (D-OH), who has been extremely outspoken against this bill, is certainly a challenge. Dingell, who has defended Detroit manufacturing against the environmental lobby for decades, has had a change of heart. Now that the Motor City isn't the vast field of smoke stacks it once was, that change may be sincere. As the newest environmentalist, perhaps Dingell can understand that a well-tuned and maintained vehicle gets higher mpgs, is therefore better for the environment, and we should be removing barriers to convenient and proper vehicle maintenance.
HR 2694 now has eleven co-sponsors and has been referred to the House Energy and Commerce committee. No Senate legislation has been introduced as of press time. The MRF encourages you to contact your Federal Representative and ask them to co sponsor HR 2694. As always, the MRF will keep you posted on any developments.

The Motorcycle Riders Foundation issues urgent call to action.

US House of Representatives passes transportation appropriations bill (HR
3074) by a vote of 268-153, with no restrictions on any motorcycle funding the Motorcycle Riders Foundation reports.
The US House passed the much needed transportation, housing and related agencies funding bill late Tuesday night without provisions eliminating funding for what is known as the Section 2010 motorcycle safety funds.
The day before debate began on this bill it became known to the MRF that Representative Jeb Hensarling (R-TX) was going to propose an amendment that would have zeroed the funding for fiscal year 08 on the motor cycle safety grants. The same grants that were welcomed by 44 states in fiscal year 07. This amendment would have saved the taxpayers a paltry six million dollars.
After hearing from hundreds of motorcyclists, some intense political advice, and a healthy amount of careful consideration Mr. Hensarling decided not to introduce the amendment. Hensarling was faced with the choice of potentially saving a few thousand lives or saving the taxpayers a few dollars. In the MRF’s view he made the correct choice.
The section 2010 motorcycle safety specific funds that the MRF and its supporting organizations worked so hard to have included in the last highway bill (PL 109-59) remain intact and the popular grant program continues to be a success.
To put things in fiscal perspective, the motorcycle safety grant program accounts for about one half of one one thousandth of this entire spending package. "In other words, the motorcyclists are asking for chump change in the grand scheme of this legislation" Said Jeff Hennie, MRF vice president of government relations.
"What a great example of how motorcyclists get things done in Washington DC" Hennie continued. "Every motorcyclist who phoned in to their federal representative earned and deserves the freedoms that we all enjoy".
The $104.4 billion dollar spending measure is now slated to be debated in the Senate, where no anti motorcyclists provisions are expected, and then on to the White House for final signature under a potential veto threat.
The MRF thanks all of its members and supporters and will continue to keep you up to speed on all happenings in your nation’s capitol of Washington DC.
As for the remainder of Mr. Hensarling’s proposed amendments? They all failed on the House floor. Maybe there is hope for wisdom in Washington after all.

URGENT CALL TO ACTION
The Motorcycle Riders Foundation issues urgent call to action.

The United States House of Representatives is scheduled to consider the
FY2008 Transportation, House and Urban Development Appropriations bill (HR
3074) Tuesday July 24th 2007. The Motorcycle Riders Foundation has learned of a last minute attempt to eliminate the funding of the 2010 motorcycle safety grant program created in the last highway bill (PL 109-59).
Representative Jeb Henserling (R-TX) is the author of the amendment as well as many many more all directed to eliminate funding for various safety programs and other programs deemed by Heserling as unnecessary and a waste of money. Henserling who is head of the ultra conservative House caucus known as the Republican Study Committee routinely attempts to eradicate funding for good programs. The RSC aims to keep the budget balanced, fight off new taxes and advance the uber conservative Republican agenda.
"A balanced budget and low taxes are both good things but Henserling severely missed the mark when he chose to use the elimination of funding for motorcycle safety awareness programs as the vehicle to bring down the national debt" said Jeff Hennie Vice President of Government Relations for the Motorcycle Riders Foundation. He added, "with motorcycle rider-ship and fatalities both at all time highs; it's completely irresponsible for Mr. Henserling to want to remove this much needed and wildly popular safety grant program."
Not to mention the House Appropriations Committee has already had several rounds of hearings and markups on this bill and then agreed to keep all of the programs fully funded and to increase funding for some the very same programs Henserling wants to cut.
In accordance with House rules, Henserling does not have to pre-print or pre-file any of his amendments. He can simply go to the floor with his amendment in hand and drop it on the desk of the clerk. Because of this no amendment number is available as of press time.
In order to stop this amendment from passing the US House the MRF is asking you to contact your Federal Representative as early on Tuesday, July 24th, 2007 as you can. This bill could be considered as early as noon EST on July 24, 2007. Ask your Representative to vote no on the Henserling amendment to remove funding ($6 million) for motorcyclist safety to the FY2008 Transportation, Housing and Urban Development Appropriations bill.

August Meeting 

Here are the two main items for the August General Membership Meeting.
Check them out and discuss them with Warriors in your district.

General Membership Meeting agenda for August 18th, 2007

At the May General Membership meeting a Special General Membership Meeting was approved to vote on changes to the Goals and Objectives for the association. It was also stated that we need to make changes to the Bylaws and to vote on a proposed increase in membership dues to $30 individual and $50 per couple annually.

Below are the old goals and objectives that has the ones marked that have been accomplished.
Following that is a copy of the Bylaws for your consideration. Think what changes you believe should be made in the Bylaws for the foreseeable future of the association. The Constitution was amended during the May meeting and is not on the agenda for this Special called meeting.
This is your association so please attend and have your say.

A mission statement is a broad and general philosophical statement that expresses the most basic purpose of the organization. It answers the question of who are we and why are we engaged in this enterprise.

A goal answers the question, "where are we going?" and is closely related to the mission statement. A goal is a long range statement of what is to be accomplished, reflecting the norms, values, and culture of the organization and engendering a common sense of purpose among the members of the organization. A goal is significant, specific, difficult to achieve, but it is attainable. A goal must be identifiable and have a time limit in order to know when it has been reached.

An objective is a specific statement of measured amounts of progress toward meeting a goal. An objective is an identifiable step that is taken toward reaching a goal. It answers the question, "How will we get there?"
An objective should involve a stretch, but must be achievable and measurable. An objective has three components: Quantity (how much), time (when), and outcome (what). Objectives provide the basis for evaluation of progress toward achievement of goals.

GOAL NUMBER ONE:
Working toward the repeal or revision of laws affecting freedom of choice, returning of freedoms, and the regaining of the form of government envisioned by the founding fathers - the vision being individual liberty, freedom, and self responsibility.

Objectives:
1. Repeal of the state mandatory helmet law. (Done in 1997 but not finished)
2. Enactment of a law precluding discrimination against those wearing any type of motorcycle attire. (Vetoed by Gov. Perry)
3. Rider education counting as drivers test. (Done)
4. Allowing handicapped and disabled veterans owning a motorcycle to acquire appropriate license plates. (Done)
5. Repeal of the portion of the federal mandate demanding that states have a mandatory helmet law. (Done)
6. Approach the aspect of a law whereby insurance companies must notify the Texas Department of Transportation Enforcement Division within the first 24 hours of lapsed vehicle liability. Also, law enforcement personnel confiscate the license plates of the car without adequate insurance within the first 48 hours of lapsed insurance and return of the plates cannot occur for 60 days at which time proof of insurance must be presented.
7. Establish a legislative office in the State Capitol/Austin area by the first month of 1997. Included in this is a sufficient amount of funds to maintain the office for the first six months of operation. It also includes; personnel (state director and secretary) adequate data processing equipment, and other administrative items. (Office established but not enough funds to run it)

GOAL NUMBER TWO
Individually and collectively assisting in the education of others relative to the use of motorcycles as transportation, safety, and pleasure.

Objectives:
1. Dispel the theory that a burden exists on the taxpayers money.
2. Assist motorcyclists in understanding the importance of motorcycle rider education. (Done)
3. Teaching other riders the importance of acquiring and maintaining appropriate insurance coverage. (Done)
4. Promoting the attendance at the Motorcycle Riders Safety Course by the majority of the members of the association. Also, promote the attendance of all members of the association attending the Experienced Riders Course.
5. Institute an alcohol awareness program within the association and a Dial-A-Ride campaign in the state.
6. Create a manual for association members that reflects safe-riding techniques.

GOAL NUMBER THREE
Educating ourselves and others and being involved in the legislative process.

Objectives:
1. Learn the rules and play by the rules. (Done)
2. Having five hundred motorcyclist delegates at state legislative conventions. (Done)
3. Recognized as a political influence in the state. (Done)

GOAL NUMBER FOUR
Better the image of the motorcyclist of today.

Objectives:
1. "Set the example" at motorcycle functions, and other gatherings. (Done)
2. Attend politically oriented rallies and meetings with conduct reflecting our mission. (Done)

GOAL NUMBER FIVE
As motorcyclists and leading citizens, peacefully co-exist with neighbors that reflects our heritege and purpose - Liberty.

Objectives:
1. Practice behavior that includes, integrity, orderliness, honesty, truthfulness, courage with consideration and commitment to being principle centered as were the country's founding fathers. (Done)
2. Help those without transportation to the voting polls to get there using a vehicle with four wheels. (Done)

GOAL NUMBER SIX
Effective communication with the media, elected officials and neighbors.

Objectives:
1. Seek and speak with media persons to allow truthful coverage of motorcycle events and activities. (Done)
2. Provide editorial material to newspapers reflecting our mission or in response to negative or unproven news articles. (Done)

GOAL NUMBER SEVEN
Increase the amount of members in the association with an ultimate level of 50% or more of licensed motorcycle operators in the state.

Objectives:
1. By the end of 1995, have 2500 total members (Done)
2. By mid 1996, reach a membership level of 5000 members.
3. By the end of 1996, have a District Advisor in each state senatorial district.
4. At the end of 1997, have at least one chapter established in each state senatorial district.
5. Acquire and maintain a process that allows those wanting to use a credit card for initial membership and or renewal of membership to do so by the second quarter of 1996. (Done Late)
6. Institute a optional membership renewal program allowing members to renew for one year at a time or a three year or five year renewal of membership by the third quarter of 1996.
7. Acquire and maintain a process providing a plastic (credit card type) membership card depicting the association emblem by mid 1997. (Done)

BY-LAWS
These By-laws shall govern members and chapters of the Association. They will remain subject to change by a simple majority vote, of those members present at a general membership meeting, as such changes are deemed necessary.

Article 1

Meetings The order of business shall be :
(A) Invocation
(B) Pledge of Allegiance
(C) Reading of minutes
(D) Financial Report
(E) Old business
(F) New business
(G) Open floor discussion
(H) Adjournment

1. General meeting shall be held during the month of May. Advisory Board meetings shall be held during the months of February, May, August and November. When the Board meetings coincide with the general meeting, the Board meeting shall be conducted at 11:00am and the general meeting shall be held at 1:00pm. Date, time and location of state meetings will be published in the state newsletter. Special meetings may be called by the state chairman, or any four advisors. Written notice must be received by all parties involved at least 10 days prior to the meeting.


ARTICLE ll

MEMBERSHIP

Upon payment of proper dues, a new member shall receive a membership card and a member Patch. A renewal shall receive a new membership card and a rocker, denoting the number of years as a member. Dues will be set by the Advisory Board, published in the newsletter, and shall be voted on at the next general membership meeting. Any member, delinquent in their dues shall lose all privileges of membership until dues are paid.
Lapsed memberships may be renewed and keep the same number providing all back dues are paid and they have not been lapsed more than two years.
Honorary membership may be bestowed by the state chairman, with approval of the advisors. Any member may address the Advisory meeting, provided they are recognized by their Advisor. District and chapter meetings will be scheduled by those responsible for the meetings, but none may be scheduled to coincide with state meetings.


ARTICLE lll

ELECTIONS

Elections shall take place during odd numbered years. Nomination petitions shall be accepted at the state office. Petitions shall include a brief biography (75 words or less) and be signed by (3) three members in good standing. Petitions shall be placed in the state newsletter, along with a ballot, at least 30 days prior to the May meeting. Voting will be done by mail, prior to the May meeting (no ballots will be accepted at the meeting).
A committee, appointed by the Advisory Board, just prior to the May meeting will count the votes. Winners shall be determined by a simple majority vote. New officers will be seated at the beginning of new business, during the general membership meeting. Term of office will be two years. All members shall elect the state chairman and members shall elect Advisors from their district only.

LOCAL CHAPTERS

Chapters may be formed anywhere in the state, but must coordinate with their district advisor, or with the state chairman if no district advisor exists for that district, so as not to interfere with an existing chapter.
Chapter officers should be - Coordinator, Assistant Coordinator, Secretary/Treasurer, and Legislative Officer but are not limited to those positions. Only members in good standing may be members of a chapter. No member may be a voting member of more than one chapter. Chapter membership lists, denoting officers, shall be filed with the state office, and
updated routinely.

Duties of Chapter officers

The duties of the coordinator shall be :
To preside at all chapter meetings To have general supervision over the daily affairs of the chapter, and to represent the chapter at all public functions. To appoint any persons or committees, not appointed by the chapter.

The duties of the assistant coordinator shall be :
To perform the duties of the coordinator in his/her absence. To chair committees appointed by
the coordinator. To assist other officers in the performance of their duties.

The duties of the Secretary/Treasurer shall be :
To keep a record of all chapter meetings To send out notices of all Special meetings. To handle
all correspondence, relative to that office. To be in charge of all chapter funds and to make payments from those funds, when so ordered by the chapter. To keep a record of all financial transactions and produce a financial statement quarterly, or when called upon to do so. If these
offices are split, the secretary shall perform 1-3 and the treasurer shall perform 4-5.

The duties of the legislative officer shall be :
To be the primary contact between the district advisor and the chapter on legislative matters. To report on legislative matters at chapter meetings and to establish phone trees within the chapter. Meetings should be patterned after state guidelines


Article V

FINANCES

Annual dues and any donations, sent to the state office, will fall under the direct control of the state secretary/treasurer and shall be used for state business only. The May meeting shall be used to further Motorcycle Awareness and as our primary fundraiser. Chapters may raise funds locally to be used for chapter business dealing with legislative matters. The state shall have no claim on chapter funds. No money may be given to a political candidate in the name of the association. Members are encouraged to take part in political campaigns, both financially and personally. No money raised in the name of this association, may be used to purchase alcoholic beverages. No chapter of this association shall sponsor a fundraiser for any reason, except to help a downed member or to further our legislative and educational agenda. State chairman and secretary shall be paid positions.


MISCELLANEOUS
Any member or chapter, acting in such a manner as to be detrimental to the association, may be called before the board. Such charges must be in writing, presented to the appropriate advisor, or to the state chairman if no advisor exists for that district. All parties involved shall be notified to appear before a special called board meeting at the earliest possible date. Board ruling could result in exoneration, reprimand, suspension or expulsion of charged party(s).
Any member may express his/her political opinion as long as it is made known they are personal opinions. Any statement of association policy must be cleared with the state chairman. These By-laws may be amended by a simple majority vote of members present at a general membership meeting.

It will be September 22nd at STUBBS Bar-B-Q in Austin, on the corner of Red River and 8th Street.

The Con for your vote 

Congressman Holt’s ‘Voter Confidence and Increased Accessibility Act of 2007’ (H.R. 811), is named like all the other bad bills (Clean Skies, No Child Left Behind, Patriot Act, etc...), assuming we are all dumb! "Confidence" is something a Con-man gets so he can pull a fast one on you.

A "yes" vote on the Holt bill allows the federal government to erect an impenetrable wall between American voters and their votes. It will lock in secret vote-counting technology owned by corporations. The public will be shut out for good. Centralized control of voting is a form of tyranny, pure and simple. Joseph Stalin is said to have explained why: "Those who cast the votes decide nothing. Those who count the votes decide everything."

Call the U.S. Capitol switchboard at 800-828-0498, and ask for your Representative. Respectfully tell the aide in your Representative's office that you want your Representative to vote against H.R. 811.

UPDATE 

UPDATE 7/9/07
The Chapter in Dayton got kicked off in good style. There was good attendance and we signed up a few new members. Thanks so much to the Liberty County Chapter of the San Jacinto High Rollers M/C for their support and for making their Clubhouse available for the meeting. Officers were elected and it was decided to meet the 1st Tuesday of each month. The Chapter name will be determined at the next meeting. Of all the ones I heard suggested the Trinity River Chapter sounded the best to me but they will be taking a vote on all the proposed names.
We received an Email Wednesday that Preacher Ball had passed away.
Preacher was a Gypsy International Red Rocker, a Shriner and District 27 Advisor and Charter Life Member of TMRA 2. We went to the Valley on Thursday in bad weather and attended the services for Preacher on Friday.
It was a fine service for a great Warrior, family man, Brother and friend.
It will be impossible to replace this great man but hopefully someone will step forward to be the one to post political issues for all in the Valley and elsewhere to read.
We drove back home immediately following the service in even worse storms than when we went down.
I caught hell for discussing the Immigration Bill from a non member who does a newsletter. Guess that will happen again but I have to put this out to you members. On the Lou Dobbs Show they were talking about the law making it illegal to hire illegal aliens and the federal govt doesn’t want the states to begin enforcing that law. The reason given was that the Federal government is the biggest employer of illegal aliens. They reported that 7 Federal Agencies employ 177,000 illegals. It was pointed out that they have a simple way to check the SS Numbers and see they are fraudulent but they choose not to do so. Some of these illegals reportedly work in sensitive areas.
Hopefully you have contacted your Congressman and asked them to vote no on HR 811. The Senate has a companion Bill, S 599 which has no Cosponsors and has not moved. There is hope HR 811 can be killed in the Senate if it passes the House but it would send a stronger message if it doesn’t pass in the House. Time is running out to call.
I am back in the office today. We shall be on a conference call with Indy Texans tonight concerning the Trans Texas Corridor. Tomorrow night we will attend the Coalition of Clubs Meeting in Corpus Christi. Wednesday we will meet with Kate at Stubbs B-B-Que concerning the Concert.

Happy Birthday 

HAPPY BIRTHDAY AMERICA and Texas Motorcycle Rights Assoiciation. My son is home from the military after serving 23 years. We went to purchase Fireworks last night to celebrate. There were two City Cops and a fire marshal parked in front of the stand (outside the city limits) confiscating fireworks and writing nuscience tickets as soon as you pull out.
Both my son and I gave them hell and I asked the cop to take off his cop garb and I would see how much of a man he was.
When we had both ran around in different directions for a while raising hell we got back to the house.
My son said 'I GAVE UP 23 YEARS OF MY LIFE FOR THIS?" I am quite sure we have just recruited a hard core Warrior. Both he and his wife are Life Members.
This mornings paper said, think of a time the government has interfered when you are just going about your life. Then get mad, NOW YOU UNDERSTAND WHAT THE FOURTH OF JULY IS TRULY ABOUT!!!

Talking with the National commander 

Hi
I had the pleasure of talking with Paul Morin the National Commander of The American Legion this last weekend, he is a good man and we talked about some good men & women, just children to our old eyes, but warrior’s none the less. What he said next made me hang my head in shame. There are 800,000 cases back logged at the Veterans Administration hospitals. Young people who needed to be trained to live a life without all their arm’s and leg’s, Old vets that have to wait for health care. I asked him why the hell is this shit happening. He said that congress wouldn’t give up the money! That’s it people, your veterans have to go begging every year for money from politicians who have never felt the sting of battle, who don’t give a shit about an airman, sailor, soldier or marine after they stop a bullet. I know that you have all received emails that say support the troops, well here is another one:
Support the Troops
Wright your congress men and tell them you want them to support and co-sponsor H.R. 1382 “Mandatory Funding for Veterans Act 2007”
Tell them you want this bill out of the veteran’s affairs committee and on the floor and voted now!
