UPDATE 6/29/07 

Chair Report

Nothing going on at our capitol and nothing planned in the foreseeable future so we have been watching the House on C-Span and the Senate on C-Span 2.

Of course you are aware that the Senate Immigration Bill was killed in the senate. Probably most of you didn’t have the opportunity to watch it unfold. It was a real battle for a few days once Senator Reid brought it back up again. Having watched these people for so long I can almost vote for them when their name is called. While watching the manipulations it became plain to me that Senator Reid knew that the Bill would not pass.
I reported on the TV Show Tuesday night that the Bill would not pass but it would be stopped by a bipartisan vote. Reid was pushing for a vote so they could tell those of Mexican Descent "We tried to pass this Bill but the Republicans stopped it." Of course they won’t mention that the number of Dems voting against and Reps voting for was almost the same. That way they could get those votes from those citizens wanting the Bill to pass.
Sure enough the vote was 17 short of passage despite some Republicans voting for it.

In the House there were two things I watched of significance.
Congressman Conaway of Midland was asked to lead the Pledge of Allegiance during the House opening ceremony. He did not say "UNDER GOD". Rather he said One nation, indivisible, indivisible, with liberty and justice for all. Was this a momentary lapse of memory or was it intentional?

VP Cheney has said his office was not a part of the Executive Branch when he was subpoenaed on the attorney firings. While working on the budget the Democrats offered an Amendment to cut VP Cheney’s $4,000,000 yearly allowance for staff and his residence from the Executive Branch Budget.
Boy did that cause an uproar. Again I believe it was just for show and not intended to pass. Some in both Parties voted both ways and it fell just short of passage. If they think they sent Mr. Cheney a message I’m afraid they wasted their time.

We received an Email with a list of Laws that would supposedly take effect on July 1st. Since Bills take effect immediately if they get enough votes and on September 1st if they don’t I felt this should be checked out. I found only one of the mentioned Laws and there were companion Bills for such a law but neither passed. This leads me to believe that this message was mistaken. If you find otherwise please let us know.

July is shaping up to be a very busy month already. We shall attend the TOG Chapter meeting on Sunday the 1st then head home to welcome my son and his family home. We will be starting a new chapter in Liberty County on Monday the 2nd. I shall go back home to finish out the rest of the week celebrating with the family and get back to work.
We’ll be in Corpus Christi the 10th of July and in Wichita Falls on the 19th. We will then attend the Hot Damn Run at its new location in Brownwood. On the 28th we will meet with the American Legion Riders in Killeen. Of course we’ll be doing the Show each week and I am sure there will be more appointments before the month ends.
Have a Happy 4th and remember what the day stands for. Get back on track and be ready to defend that which our Founding Fathers and others died to give us.

Open Letter from TMRA2 

AN OPEN LETTER TO THE TMRA2 WARRIORS
As most everyone is aware there has, for the first time in our existence,
been some dissension in our ranks. Each member has my heart felt apology
for what has taken place over the past few weeks. I had hoped this
disagreement could have been resolved with the least amount of publicity
and pain to the general membership. Unfortunately it got out of hand and
festered into a major catastrophe and spread across the nation.

Thankfully calmer heads prevailed and the disagreement was worked out in
an amicable meeting between the Warriors representing the Clubs and the
Warriors representing the Independent Riders. As a result of an agreement
reached during this meeting and subsequent action the State Chair of TMRA
2 Breeze has resigned his position effective 6/25/07. The majority of the
District Advisors have voted to appoint Sputnik to that position until
such time as the association can regain it’s footing both mentally and
financially.

I am aware this action will not satisfy every member of the association
and there will be some who choose to resign or not renew their membership
in TMRA 2. There will also be some who may have considered joining that
will not do so. Either scenario will be a loss for the association and all
it has stood for these past 15 years. It is my hope that most can get past
the animosity bred over the past short period of time and be guided by
what is best for the association.

There needs to be some changes to our Bylaws to better the structure of
the association. This need was recognized during the May General
Membership Meeting. To that end a special General Membership Meeting was
called for August 18th at the State office to discuss openly and make
those necessary changes by a majority consensus of those members present
at that meeting. It is time to rejuvenate and rededicate to that which we
have all held dear over the past few years. This will be the most
important meeting this association has ever held since the first one those
many years ago which officially established Texas Motorcycle Rights
Association.

I urge everyone to stand down, take a deep breath and allow any animosity
held to dissipate. Attend this meeting and make your wishes known. This is
your association as it has been from its inception. Please take the time
to attend this meeting and let the will of the membership rule. If you
are holding sending in your TMRA2 renewals or donations, please go ahead
and send it in to us at the Elgin address.

Governor Perry vetoes Eminent Domain Legislation

Governor Perry's veto of eminent domain legislation is a serious wrong to every private property owner in the State of Texas. The governor’s reasoning was that the passing of this legislation would slow down and shut down needed construction projects at the expense of taxpayers.
However, the intentions of House Bill 2006 was not to prevent progress, but to protect the rights of private property owners from individuals wanting to build roads or other public-use projects without justly compensating landowners. The origination of House Bill 2006 was with the U.S. Supreme Court’s unprincipled ruling, two years ago, in a lawsuit challenging eminent domain abuse in New London, Connecticut. In Kelo v.
City of New London, the court upheld a private development corporation's right to exercise the power of eminent domain by seizing an entire neighborhood for private development. In her dissent, Supreme Court Justice Sandra Day O'Connor said, "The specter of condemnation [now] hangs over all property. Nothing is to prevent the state from replacing any Motel 6 with a Ritz-Carlton, any home with a shopping mall, or any farm with a factory."

From The Chair's Corner-Juneteenth

The June 19th tradition is called Juneteenth, which became an official state holiday in Texas on January 1, 1980. News regarding the end of slavery did not reach Texas until June 19, 1865 when Union soldiers reached Galveston and brought word that the Civil War was over. The Emancipation Proclamation officially freed the slaves on January 1, 1863, although it was not until the end of the war that this document had any affect on circumstances in Texas. Although Juneteenth began as a day of rejoicing for former Texas slaves and their descendents, the celebrations have spread as a day that commemorates African American Independence and freedom all over the world.

We, as an organization, continue today to fight to protect our rights that are under assault from individuals who attempt to enact unfair and questionable policies. Juneteenth provides an occasion to contemplate the promise of freedom, justice and equality that characterizes our country. As we honor our history of progress and the struggle for equality, we must rededicate ourselves to the safeguard of our most sacred rights.

recall affects Pilot Power

GREENSVILLE, S.C. -- Michelin is recalling two types of front motorcycle tires in the U.S. and Canada. The recall affects Pilot Power 2CT and Pilot Power 120/70 ZR 18 front tires with a "Made in France" marking.

Examination shows a possible defect in the tread due to a manufacturing irregularity. Michelin said yesterday no incidents of pressure loss, accidents or injuries have occurred as a result. The company hasn't said exactly how many tires are affected. Michelin said it will replace all of the affected tires and consumers can contact the company at their toll-free consumer relations number if they believe they are affected.

The governor vetoed HB 2006 the Bill to make it harder for government to take your property. It would have required that they make an offer for the property before condemning it and they must show you an appraisal of the value at that time. Cities, Counties and the state argued that would cost too much money.
Imagine that, it would be to expensive to pay a fair price when taking someones land.

We had a good time at Old Sawmill Town this weekend. Of course it rained like always. The weather caused me to leave early but I got a special Fathers Day Gift when Janet "Z" sang 'Wind Beneath My Wings' just prior to my departure.

Urgent Situation in Wichita Falls 

Star a Proud Texas Marine Mom and Secretary/Treasurer DFW Region Texas COC has reported that a very popular woman in Wichita Falls has passed away while riding.
According to Star this woman was playing tennis, left the courts and told her friends she wasn't feeling well at all. Onlookers to this accident told police that she was driving very unusually slow and then bounced off of two curbs and then fell off the bike. Newspaper article (posted below) makes it sound like she died from head injuries due to not wearing a helmet - but it's obvious she had a heart attack, stroke etc. No she did not have a helmet on but there is more to the story. She was sick at the tennis courts, left, was going very slow, hit a curb, then hit another curb, 3rd curb stopped the tryke, she slumped over and was out and gone.
Then her body fell off the tryke. It appears there are no head injuries at all,that it was either a stroke or heart attack. She was unresponsive at the scene but breathing, the doctors put her in an induced coma.

A Wichita Falls woman remains in critical condition at a Fort Worth Hospital after being in an accident, Tuesday, while riding her motorcycle 63 year old Linda Merrill was not wearing her helmet. To remind cyclists to wear their helmets and be more safe on the road a local man is starting a motorcycle safety coalition.
Steve Holley has seen too many friends get into accidents on their motorcycles and weren't wearing helmets, including Linda Merrill. Before the law changed in 1997 all cyclists were required to wear a helmet. These days, in Texas if you are older than 21 you are not required to wear a helmet if you have completed a motorcycle safety course and you have at least ten thousand dollars of medical insurance.
Next meeting is June 21 at 7 in Luby's Cafeteria. The meetings are open to the public and not just limited to motorcycle riders.

Beloved former Old High teacher passes away June 15, 2007

Linda Merrill, called "as famous as you can get in Wichita Falls," died this morning from injuries she suffered in a Harley trike accident Wednesday, according to the Wichita Falls Police Department. She was 63. Merrill and her husband, Gene, shared their retirement years riding the Harleys, telling the newspaper when she left the school district in 2003 that she looked forward to the time she could spend on the three-wheeler motorcycle. She was not wearing a helmet when she started driving the short distance to her home from Weeks Park, where she'd just played tennis.
Friends wondered if she may have suffered a stroke or aneurysm, the Times Record News reported, causing her to drive it unusually slow and strike a curb, the jolt throwing her off the motorcycle. Jan Inman, a friend, told the Times Record News Merrill was "a Coyote through and through." She spent 29 years at the high school, first teaching reading, English, government and history. She later became an assistant principal and the school's magnet coordinator. Funeral arrangements are not known at this time.

This is a tragedy, we lost a loved rider and one who exercised her freedom of choice to ride without a helmet. It is a very sad day when individuals take advantage of the lost of a loved one to benefit their own cause.
Wichita Falls has not even had time to morn her death. Please remember her and her family and friends in your prayers.
This is a coalition we need to stop. Let’s give support to Star and show up.

Workshop in Bastrop 

This weekend we attended a workshop in Bastrop hosted by Independent Texans primarily to lay plans to work against the Trans Texas Corridor.
These people represented some of the most powerful minds in the political arena from groups all across the state. Those of us present busted with pride to see how high we ranked in the esteem of such a crowd. I believe a strong coalition will develop as a result of this meeting.
Saturday’s meeting was held at a Motel called Loblolly Pines., a beautifully landscaped 38 acre tract of land with all we could possibly need in the way of conveniences to host events. Swimming pool, meeting room, small restaurant with outstanding food, volleyball courts and a giant band stand with 4000 watt speaker systems to list some amenities.
And last but not least an owner who recognized me as I sat at a picnic table catching my breath and came over to let me know he is biker friendly and if I ever found myself needing a place for a meeting or anything else his place was available. I’m sure we will be seeing more of him and Loblolly Pines.
There were several workshops and speakers spanning 11 hours on Saturday at which time the audience had time to interact with the speakers. The final session was:

What an honor for TMRA 2 to be asked to sit in with this group of those who have fought the special interest and won. I was yet to learn what a great personal honor and an uplifting experience it would be for me personally.
Bill Addington was asked to speak first about his 8 year battle to save his ranch in Sierra Blanca, founded by his ancestors, from being turned into a Toxic Waste Dump. He fought Hudspeth County officials, the Federal Government and the Mafia, turned loose on him with government blessings, to a standstill and WON !!!
This quiet unassuming man related stories of stress and persecution never experienced by average men or even by those considered to be great men in every day life nor in battlefield combat. He spoke of death threats and of racing down the highway at top speed while being fired on and receiving as many as 4 bullet holes in his vehicle. His wife took their child and left him because she couldn’t take it any more. His key to victory? Nothing is a done deal. You just have to believe that you can win.
Bill Addington is a true Hero. A man I would gladly follow to Hell to make changes if the opportunity arises and I am certain it has. What does he say to this as we sit at that table together?
The greatest thing he has ever seen in his life was the front page of the El Paso Times the day after the Democrat State Convention with Sputnik standing on the stage confronting Molly Beth Malcom and the headlines reading BIKERS STORM THE STAGE. Sputnik became a hero to him.
At a time when my personal health and my faith are at an all time low God sent me Bill. BY the end of the day I was breathing without oxygen. BY spending quality time with this man again on Sunday I once again believe.
Thanks to Bill Addington for coming into my life. I once again believe.
Now bring it on I am ready for victory.

Chairman update

This is in response to Sputnik’s, TMRA II Chairman Emeritus, post on 6/6/07 concerning the Austin Minutemen Chapter meeting at Cindy’s Gone Hog Wild stating that I plan to close down the Elgin office and replace Terri, the State Secretary, and Jan, the State Treasurer. For the record, I am stating my concerns and the rest of the facts. As the elected State Chair, I am responsible for the overall success or failure of the organization. There are many areas of the organization that I am concerned with, mainly the infrastructure and how we are doing business. I bring many qualities to the organization but principally the ability to plan, the ability to rally members behind the plan, and the courage to win and overcome all obstacles at all odds. I was elected to office 5/5/07, and one of the first areas I looked at was the finances of the organization. The finances, which are published in the Warrior for 2006, affirm that the TMRA II had an income of $72,550.05 from members and donations and expenses were $71,548.62. In 2006, office rent, which is a house trailer, not an office, and not a good location, totaled $7800.00. Utilities for the TMRA II were $2,352.51, phones $2,538.10, propane $605.00, and Internet service $718.70. I made a recommendation in order to curb spending and planned to meet with the District Advisors on June 26, 2007 at 8pm to relay these concerns.

In addition to the previous mentioned concerns, I am also requesting that the organization postpone the publishing of the Warrior until the funds to pay for this service are readily available. Last year, $9084.09 was spent on publishing the Warrior.
Sputnik proposes $12,000 to publish the Warrior in 2007. The warrior is posted on our website and the organization has the ability to email this publication to members as well. For those members without e-mail addresses, the public library is easily accessible if they feel the need to read the Warrior and pull it off of the website. The Warrior shares information with our community, however, I am confident that our members will understand the need to slow down on spending. I don’t mind sharing this with the members and community because it should be public information but we are thousands of dollars in the red. We owe the IRS taxes from 2003, 2005, and have taxes to be paid in August. Last year, the TMRA II paid our secretary a salary of $15,158.88 a new secretary would cost $1200 a month, which would give the organization an immediate savings of $3600 a year. The one aspect that really stuck out, after pulling all of this information together, was that during the year 2006 the TMRA II only spends
$408.69 on advertising. For the year 2007, Sputnik’s proposed budget is $83,600 but he states that we need to have $100,000 in income just over $9,000 a month to break even. Unfortunately, at this time we only have revenue at $72,000, which we are already over budget of $11,049. Sputnik stated that I made no mention of raising funds, although in the beginning of the meeting I stated the District 14 Advisor was not at the meeting because I had scheduled a meeting with the Hill Country BMW riders to present information about our organization and become members and club sponsors. In addition, it is difficult to have fundraisers with no funds to support them.

I have found an office in Austin, that is approximately 7 minutes from the Capitol, and I must state that it is an office not a house trailer; the cost is $650 a month. There is all modern equipment including computers, Internet, electricity, phone, Internet service, and the organization would not have to pay for propane.
The TMRA II would still have the expense of $7800 a year for an office but it would reflect the image of the TMRA II; however, not having to pay additionally for utilities, phone, propane, or Internet service will save our organization $6,200 a year. When I was discussing my concerns about relocating the office to Austin with Terri, she told me because she lives at the house trailer in Elgin with Sputnik she would quit and no longer be the secretary for the TMRA II. This discussion forced my hand to be prepared for this change and to start looking for a new secretary to replace her. Sputnik, unfairly says that I also wanted to get rid of Jan, our State Treasurer. Sputnik himself had informed me that Jan was no longer wanting to be the treasure because she is getting ready to retire and travel wit h her husband. I have talked to Jan and she expressed this sentiment to me as well. The issue at hand is that we are asking members to join our organization, and we are asking clubs to support us, I feel that as Chair of this organization if I am asking for money and support from members and clubs then the funds have to be managed and the organization accountable for spending. I cannot at this time ask another entity for funds because of the current mismanagement of funds within this organization. Since I have taken office, I have asked Terri on several occasions to provide me with information, and have requested the corporate charter, the non- profit paperwork, as well as the current membership database, to date I have not received anything from her. What I am attempting to do is to place structure in the TMRA II and make sure that all members are accounted for and their renewals for membership are completed in a timely fashion. I want to also provide a P & L report to anyone that would like to see it. I was upfront with Sputnik; sharing with him that these changes needed to occur and for some reason, certain individuals have chosen to wash our dirty laundry in public. I talked to the District Advisors per phone conversations and relayed to Sputnik that eight of the 15 TMRA II District Advisors agreed that change should happen within this organization. The only argument to keep the house trailer is that Sputnik needs a place to shower and a place to stay when he is in town. The TMRA II has 18 months to be ready for the next legislative session. There is a lot of work ahead of the TMRA II, it is essential that we refocus our organization and to select what battles we want to fight. We cannot fight them all. I am smart enough to know and so are our readers that there are two basic parts of being at the capitol. One, to get bills that we support into legislation and the other is to fight the bills that we don’t support. This year was not a loss, we successfully defeated Senator’s Corona’s helmet bill which would have required both a rider’s training course and $150,000 in medical insurance to ride without a helmet; also, this bill would change the penalties of not wearing a helmet from a $10 minimum to a $500 minimum and a maximum of $50 to $1500. This bill was defeated in committee because of the excellent work of our staff, the research that was compiled and presented to the committee, and the members and clubs of our organization that made many calls and visits to the capitol to voice their concerns, a job well done.
This alone was a big win for all. House bill 1279 was passed and relates to traffic control devices requiring them to detect the presence of a motorcycle. Currently, all detectors at traffic lights can be calibrated to recognize a motorcycle. However, often times they are not. As a result, motorcycles riders have to wait at a red light for an extended period, which can be a frustrating experience.

We teamed up with the Corridor Watch, which will be good for us in the future to develop allies for our cause and although they took out the 13th Amendment, which is a two-year moratorium, the bill that passed was still successful because there are many loopholes to slow down the selling of Texas to the big corporations. One representative that we can thank for this is Lois Kolkhorst. State laws written in 2003 gave private companies a key role in building and operating toll roads. We were able to reach a compromise that local toll road agencies, rather than being private operators, will get first shot at building and operating turnpikes. The bill also limits the signing of private toll road contracts over the next two years. This was a sensitive issue and our concerns were that Governor Perry’s highway plans would overtake the landowners, in addition, people do not like the idea of paying tolls especially motorcycle riders who have to stop, put down their kickstands, and dig into their pockets for change. Our organization is all about members weighing in and having some say in how to fix issues, and we value all our members concerns.

I would like to say that our organization is better off with the work that has been done and has been done against all odds. I understand that fourteen states have passed helmet laws. We have a lot of work ahead of us over the next two years, and we will be challenged. I will be focusing on the infrastructure of the organization and prioritizing what issues, we will fight and work towards financial stability. In fairness and good faith, and in the right to discussion, and the right to information, I have shared this information with all.
