Road Block Update 

Another reason to fight the Road Block Bill. The Supreme Court today ruled in a 6-2 vote that it was permissble to use drug sniffing dogs during traffic stops. According to them it does not come under the constitutional personal privacy act as they are only looking for something illegal.
We need to force Congress to reign in the Supreme Court as that is in their power to do.

ROAD BLOCK 

We spoke with Chief Beckworth concerning the road block in Grand Prarie this morning. Gave him all the information and he agreed it was an illegal road block. He called Dallas and they denied having taken part of any such action. Chief Beckworth then had a DPS officer in Grand Prarie as the road block location was within their city limits and they too denied having taken part in such an action.Please try to forward to me any further information so we can build a case.What uniforms were the participants wearing, what identifying insignia was on the vehicles involved. Anything you think may help build a case please send ASAP

LEGISLATIVE DAY 2005 Wrap Up (partly) 

LEGISLATIVE DAY 2005

The Day itself has come and gone but the memories will live for a long time Hopefully for those who were in attendance for the first time it will kindle a fire that will get them involved for the long haul. A close guess would place the number of 1st timers at about 40% of the total. The total participation was nearly double last session. You can all be proud to have been a part of it.. Bikers across Texas should be thankful for what you accomplished this Day.

Our weekend started with a few riders who stopped by the office on Saturday evening. We were doing an interview with the crew from Chromed Out Magazine concerning the association and the agenda for Sunday and Monday. They shall be working with us throughout the year to inform riders what is really happening in Austin and around Texas that will affect them. We look forward to the alliance with them. After the interview about a dozen of us went to the Krazy Horse down on Main Street for dinner. Prior to leaving we received a call from Dad who had just ridden into town and he met us at the restaurant. Walked in and found Casey Bolt and another rider already there. Everyone headed for Austin and My wife and I went back to the office.

Left the office and headed for Beverly's at 10:00am Sunday morning for the party hosted by the State Office of Texas COC. Despite the cold weather riders were already showing up and preparations were underway for a good time. We dropped off position papers and sign in books then headed to the Travelodge to set up a temporary office for the day. We had applications, member patches for new members, Rockers for renewals and thanks to Elmer McKeegan we had plenty of T-shirts on hand for sale. The office was busy immediately with people picking up position papers, joining, renewing and just generally having a great time.

Left there and went back to Beverly's in time to address the issues and explain the agenda for the following day at the capitol. Boy was it packed and the food smelled great. News media were coming out of the woodwork. Did a few quick interviews, said what needed to be said and then Bandido Jimmy addressed the gathering. We rushed back to the Travelodge to get ready to do the same thing there. The office was still filled and riders were everywhere. Our state secretary was getting broken in right but with Dee and a few others assisting she was a quick learner. Thanks to all the members who took part in getting the job done in the office. It was appreciated.

As we gathered around the pool to discuss issues and give instructions for the next day we received a beautiful blanket from Cowboy and Pam to auction off as a donation from the 1st Brazoria Chapter. They stood proudly lined along the upper rail of the balcony behind their Chapter Banner. We started off by presenting the SPUTNIK AWARD TO THE Big Country Chapter for having been the most active chapter for last year. We then announced the winner of the ANGEL WARRIOR AWARD and Mike gave it up to Del Essary of district 28 as the most supportive Advisor of last year.

We handed out the Staff Armbands and then Robert Fletcher of ABATE Confederation of Texas spoke. He asked everyone to come back to the capitol again on March 21st from 7-10:00am for Breakfast With The Bikers. This event is hosted by ABATE as a follow up for Legislative Day. They reserve a section of the cafeteria, put out plenty of snacks and drinks and invite the legislators to join the Bikers for a free breakfast and some informal talks. This was a great event last session and will be even better this year. He asked that everyone pick a third day of their choosing to come back to the capitol to make the rounds and be seen. Robert then issued a Legislative Challenge on behalf of Texas ABATE. The contestants will be given points for letters to and responses from legislators and for cards picked up during visits to state and federal legislators' offices. Points will also be received for attending ABATE chapter meetings and state functions. More points can be acquired for volunteering to work at functions. The top point getter for the year will receive $ 1,000. Now that is a prize worth working for.

Gary, the TMRA state Chair presented the Share the Road booklets they had prepared to be handed out next day and then we auctioned the blanket which brought a $200 bid from Gary. Thanks to him and 1st Brazoria. Sputnik gave a man a Mohawk who wished to show his solidarity with Sputnik and then we all had a good time. Janet (Her Highness) shared a room with us and even after the crowd played out sleep did not come easy. Laid down at about 1:00am and by 4:00am was having coffee, waiting for time to head for the battleground. Finally bounced Gwen & Janet out of bed and made what has become a routine trip for yours truly. Of course they were still tired and Gwen remarked "There must have been a thousand bikers passed through our room last night."

Unlike routine days the old fire was raging again as we looked forward to the vision of so many of our brothers and sisters walking down these hallowed halls. We were greeted in the cafeteria by Staff members eager to receive the day's assignments. Then the steady flow of leather clad constituents began to swarm into the Rotunda and the invasion had begun. Gimme Jimmy had scheduled a ride in from Beverly's for 8:30 am and a few hundred Patch Holders followed him straight up Congress to the Capitol where Da'Lady led them on a rumbling ride around the capitol before they pulled into the reserved parking and dismounted. Sputnik was there to meet them and we walked to the South door enmasse followed by the media. We stopped on the capitol steps for a photo-op by the House photographer and then as we moved for the door said "They know we are here, now let's go tell them what for." And tell them we did.

Da'Lady went on the Floor and presented the Legislative Warriors to the House with HR 62 as she wore here leathers and proudly announced her position as a rider and member of TMRA ll. Roughly 5000 riders filed through the halls on this day, nearly 40% for the first time. We are confident it won't be their last. Were we successful? You bet. Getting that many riders, well versed on the issues and ready to share our views was noted with respect by the legislators and awe by bystanders who had never expected such a sight in their capitol. Three days of constant news coverage by television, print and on the radio helped our case tremendously.

Thanks to all who took part in this show of solidarity. To the many Staff members who spent their day helping others, to those who made an appearance and conducted yourselves so grandly. All too many to name but special thanks to just a few. Thanks to Mike Alvey for filling the position in the Rotunda normally held by Sputnik. To Da'Lady for the media Blasts and arrangements at the capitol, the cake in her office and her staff who did themselves proud serving the bikers. A very special thanks to Gimmee Jimmy for all the advance preparation in bringing the 8 Regional Texas Confederations of Clubs on board. I can confidently say that no other state can bring so many Patch Holders together in their capitol at one time.

Special thanks to Robert Fletcher who stayed in constant touch to assure support from ABATE Confederation of Texas. These three groups working together are what made this event so grand. It was an honor to work so closely with these groups to make Legislative Day a day to remember. And thanks to Elmer for taking the time and trouble to bring down the shirts and deliver a scooter to the office for me to take to my brother.

Tuesday morning and the sight and sounds of the riders has left a vacuum in the capitol halls except for the shouts from across the halls and the words from those who stop to congratulate your chair on the large showing and the exceptional conduct and knowledge of those who had made the trip to Austin. We visited only twenty offices on this day due to time limitations. Only 12 were present as we made those rounds. We received 11 yeses and one no vote on HB 264. The no came from Rep. Myra Crownover who wasn't interested in facts she says she would vote to put the helmets back on our heads. You made those votes possible with your appearance on Monday. We will get down to serious business next Monday. Expect a request for letters in the near future. We shall keep a running report going throughout the months ahead.

We shall be making a DVD next week.

Update (Life of its Own) 

This weekend appears to have taken on a life of it's own. Calls are still coming in from riders who have never heard of TMRA 2 or Legislative Day before and are planning to attend.
Da'Lady has paid for rooms for the El Paso Warriors to be able to attend and has sent out a Media Blast (Press release to all major news media) letting them know the plans for the weekend.
KVUE News, TV station had already contacted us saying they will be at the capitol on Monday. Spoke with the San Antonio paper and were told they would also be in attendance.
Yesterday a lady called saying she saw the write up in Skunk Dots and put the Flyer on her wall. Said she rides with a group of 30 riders and they were coming for both days. Thanks to Skunk and Jingles for the article. Skunk will also be covering the event for another story.
Talked to Karen with the MC magazine Chromed Out. Will be doing an interview with them at the office on Saturday so they can tell folks what we do and what they can do to help during the session. If anyone can say they are unaware that there are riders working in the capitol for their rights after this they must be in a world of their own.
Another bit ofbig, welcome news. Gypsy International has sent TMRA 2 another check for $5,000 to help tide us over until other clubs kick in and start to help. A big thank you to these fine supporters. That support will help us pay the past due taxes and finally give me a paycheck.

We will stick with five issues on Monday. Helmet Bill, Failure To Yeild Bill, Insurance Bill and HJR 17 the Recorded Vote Resolution. We favor each of these issues. Then there is HB 50 the Road Block Bill. We strongly oppose this Bill.
When you go in to visit sign your name in the guest book. Put in the issue you plan to discuss and state "Please Support" or "Please Oppose".
Thanks and appreciation to all of those who will be in attendance and to you who have worked so hard to make this a big success. I will be back in the office this afternoon.

ABATE - 8 Confederations of Clubs - TMRA ll WE CAN'T LOSE

We have gotten all details worked out for Legislative Day:
The Party at Beverly's is a go starting at 10:am Sunday the 23rd. We will have TMRA 2 Reps there to sign new members and sell shirts that are excellent to wear to the capitol on Monday. We will discuss issues and procedure at 4:00pm at Beverly’s. We will have sign in books at this location on Sunday. Please give the asked for information so we can determine where the support comes from.

TMRA2 will have an office set up at the Travelodge Suites all afternoon on Sunday 23rd also. Drop by and visit with our new secretary. You may sign in at the temporary office to save time on Monday. Discuss any issues you may have concerning the association. If you have had any problems with member patches, the Warrior or member cards please report to her so we may get everything worked out. We will host an Issues and procedure meeting at the hotel pool at 6:00pm. We can sign up members and will have neat supporter shirts for sale to wear to the capitol on Monday.

ABATE will be holding a meeting at the Motel at 4:00pm Sunday afternoon. For more information on this meeting call Robert at 940-482-3564.

I believe the United Clubs of Austin well be having a meeting (CLOSED) at Travelodge beginning at 2:30PM. For more information call Casey at 512-272-8645.

On Monday morning our staff will be leaving the Motel by about 7:00am to get set up in the Capitol prior to beginning the long day of meetings. We ask that you please start your day at the Capitol Rotunda. We will have sign in sheets at each entry to the capitol for those who did not sign in on Sunday. You need not get there early as some will be coming and going all day and late into the evening. Please spend at least 2-3 hours there if possible as seeing bikers all day makes an impression. The cafeteria has good food at very reasonable prices.
After entering the capitol, if you know your Senator or Representative let us know and we will tell you where to go. If you do not know your Rep or Senator we will give you that information and send you where you need to be. To find out who represents you click on http://www.tmra2.org/. Click on who represents me and enter your zip code. For those who have never done this before we will have Staff members wearing red, white and blue armbands to assist you and answer any questions you may have. They will be on each floor and hall in the capitol and the Extension. They will be happy to go in with you and introduce you if you wish. If possible go in groups of at least three. Be sure to sign their book.

PARKING:

If you have a handicap plate or placard I recommend exiting I-35 at the MLK Blvd/15th street exit. Turn right on MLK, go up to Congress and turn left. There are nearly always spaces available at meters in that area and you don’t have to walk uphill to get inside.
If you plan to park in the Visitors Parking Garage exit at the same exit but pass MLK and turn right on 15th Street. You will go downhill and as you start back uphill look to your left. The sign will say Visitors Parking. You can park there for two hours free or three hours for 75 cents. All day is only $6.
The 3rd option is to exit I-35 at the 11th/12th street exit and turn right on 11th street. Just before you get to the capitol there is a park on your right with a parking lot. You can park there 2 hours for free. For STAFF MEMBERS ON MOTORCYCLES ONLY go on up 11th street and just before Congress there are several meters on the right. They will have caps on them and are reserved for our staff. Park angled into the curb as tight as possible to other bikes and that should hold all staff members. Park at such an angle that your bike won’t extend into the street farther than a legally parked auto would.
Finally we have arranged parking on Colorado street for motorcycles only. Go up 11th street, cross Congress and turn right. Again park backed into the curb and get as tight as safe. We ask that those planning to stay far a while park here as the legislators can look out the windows and see bikes parked there all day long. If you come down later in the day check Colorado for empty spaces first.

In Closing:
It was brought up at the Houston COC meeting that we should tie yellow ribbons on our bikes and vehicles to show our support for those fighting the battles over seas.
We will be surrounded by TV and newspaper crews looking for a story. They are great hands at getting riders to spout off and then twisting it for sensational reporting. Please don’t get trapped out by these people by seeking forceful personal exposure. It would be greatly appreciated if you would direct them to a staff member. If you chose to talk to them keep it short and give facts correctly without personal flourish.
Thanks to all riders who have taken the time to make the trip to Austin. For those who have been here before welcome back. For those of you who are here for the first time. You are about to have the time of your life.

UPDATE 

Well the session is underway with plenty of pomp, speeches and a carnival atmosphere as usual. Legislators were sworn in and then it was plenty of receptions with food and drink. We met with all the new legislators and welcomed them to Our House. We asked that they remember they are there as representatives for the will of the people.
Unlike other sessions I managed to make an enemy, or should I say solidified a poor relationship with a Senator. Stopped in Kim Brimer's office and was greeted warmly by his staff. He walked out and I started talking to him about our upcoming Helmet Bill. He very rudely and loudly said get out of my way Sputnik and pushed his way past me. I turned and told him "Get out of your way Hell, you're the one who is in the way up here. His entire staff cracked up laughing. Needless to say we can not expect any help from him but we didn't have support there anyhow. He is one of those Reps who decide they are God when they cross the aisle to the Senate.
There was a large Rally on the capitol steps in support of Rep. Vo who is being charged with voter fraud by Ex Rep Heflin who lost in the vote and the recount. The House will hold trial on the 27th to hear evidence by Rep. Hartnett who has been appointed to gather all information concerning the charges. The House will make one of three choices sometime in Feb. They must allow the election to stand, return the seat to Ex Rep. Heflin or call for a new election. Unfortunately either choice will cause dissension.
Today the House worked on new House rules for the coming session. The Senate introduced SB 2 the Education Funding Program. Gov. Perry says there won't be an increase in taxes but their Bill calls for a state property Tax, revamping the business Taxes, Taxes on Cigarettes, Tobacco and Alcohol Tax increase, increase the Sales Tax and several other Taxes but there won't be an increase in Taxes. Sounds like politician talk to me.
Tomorrow both Houses will be working on the Recorded Vote issue. That will be fun to watch. They will not be in session next week as many of them travel to DC for the Presidential Inaugural Parties and the Inauguration.
I will go home and attend the Houston COC meeting on Saturday and try to get to the D/FW COC meeting on Sunday. Only five people have volunteered to be Staff members on Legislative Day. We need way more than that.
We will have member applications, member shirts and Supporter shirts at the Travelodge on Sunday. We have set aside a room to be used as an office while we are there. Stop in and visit.

I am happy to announce that all the rooms we blocked have been reserved. They also went ahead and gave us all the rest of their double rooms.
Rober at the Travelodge Suites has made arrangements with the Red Roof Inn(right beside them) for twenty more overflow double rooms at the same $45 price.

Update 

Met with Rep. Hunter and staff this morning. Rep. Hunter said they will be working on our Failure To Yeild Bill today and it will be filed by opening day.
Rep. Rose told us he would be getting with us later this week on the insurance Bill. We asked that he change the wording of 'dangerous behavior' to risky behaviour like the federal Bill reads.

Had a long discussion with Rep. Kuemple from Seguin concerning Cosponsorship of HB 264. He agreed that something needed to be done. He said let him do some legwork on the problem, talk with Colonel Dudley and see why this problem still exists. Rep. Kuemple is a senior member of the House and a very well respected legislator by both Parties, he is a Republican. His cosponsorship would be a real boost in our chances.
More when it happens.

Letter to your Representative 

With all the misinformation going round I feel we should post this letter to everyone we have an address for and hope it gets placed on several websites. This note will be hand delivered to all 150 House members. This isto let everyone know why we ask that the Law be changed. Read it and be able to let your legislator know of problems in your area.

Honorable House member;
During the 1997 Legislative Session many of you were present in this body when Representative Jim Pitts offered HB 473 to allow Texas adults to be allowed to ride a motorcycle without a helmet. You supported that Bill. SB 99 introduced by Senator Patterson came over with amendments placed there by Senator Wentworth and the House cleared those Amendments sending the Bill back for Senate concurrance. The Bill ended in Conference and the House Conferees refused to concede to the Amendments.
Finally in an attempt for closure we asked the House Conferees to accept the Amendments and let's see how it worked out. Enforcement of this law proved to be a nightmare from day one. Unnecessary tickets were issued from the Sept. 1,1997 effective date of the law. These tickets cost time and money for riders engaging in a legal activity and created animosity almost to the breaking point between riders and enforcement officers. Despite working diligently with leaders of all agencies and judges to alleviate problems it was clear the officers and some judges would never accept the intent of the law.
During the 2001 Session Representative Chavez intoduced and the House passed HB 2585 to rectify the existing problem. Again the Senate changed the Bill to make it less explicit and the problem has continued to escalate. Officers still do not know the law and continue to write illegal tickets. Stops for non-helmet useage turn into fishing expeditions in some cases resulting in illegal searches. Judges admit to not knowing the law. Riders are forced to ride hundreds of miles, not once but twice, to plead their case in court. Though knowing the case will be won in court most just choose to simply pay the fine rather than go through the motions of a trial. It is far cheaper than losing two days work and spend those days traveling and sitting in courtrooms.
With no evidence that the Amendments placed on SB 99 in 1997 could or have saved the taxpayers any money or saved lives we have continued to try and work out a way to make the law acceptable. Our efforts have proven useless. Therefore based on the following true and provable facts we ask that you as a member of this Honorable Body support repeal of the helmet law amendments and give us the clean Bill given to us by the House in 1997. Let those who have attained the age of 18 or older have the choice to ride without a helmet in Texas.

(1) State law says riders must carry medical insurance to ride without a helmet. The Federal govt. says group medical policies must be available for riders but insurers need not pay benefits for injuries incurred while riding a motorcycle. Therefore this state law mandates that riders purchase a product that does not meet the requirements of the law.
(a) Last session Representative Burnam sponsored our Bill to change insurance law to require insurance companies pay benefits to policy holders injured while involved in legal activities. We couldn't even get a committee hearing on the Bill.

(2) False claims that the Amendments would save the taxpayers money were accepted by some in the Senate and therefore the Amendments were added on that side of the Legislature.
(a) A study done by Texas Department of Health showing that riders injuries were paid by self pay at about the same rate as other traffic injuries was presented to the Senate in Committee and ignored.
(b) Riders pay higher taxes than the average Texan so naturally any item that would save taxpayer dollars would have our support.Stop the misunderstandings encountered by Law Enforcement and riders alike and pass this Bill that gives a simple easily understood solution to an unnecessary problem.
